1. Acceptance of Terms

By creating an account or using Trivium ("the Platform", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and Trivium ("we", "us", "our").

2. Description of Service

4. Subscription Plans and Payment

4.1 Free Tier

The free tier includes limited access to the platform with restrictions on the number of thinkers per conversation and monthly message limits.

4.2 Paid Subscriptions

4.3 Refunds

Monthly subscriptions: No refunds for partial months. Annual subscriptions: A pro-rata refund may be requested within 14 days of purchase if you have not made significant use of the Service. Contact us at billing@trivium.education.

4.4 Free Trials

We may offer free trial periods. At the end of a trial, you will be prompted to subscribe. If you do not subscribe, your account will revert to the free tier. Trial abuse (creating multiple accounts, using disposable emails) may result in account termination.

6.1 Your Content

You retain ownership of the messages you send. By using the Service, you grant us a limited licence to process your messages for the purpose of generating AI responses and providing the Service.

6.2 Our Content

The Platform, including its design, code, prompts, supervision topics, and educational materials, is owned by Trivium and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

6.3 AI-Generated Content

AI-generated responses are provided for educational use. You may use them for personal study, revision, and academic work. You are responsible for verifying the accuracy of AI-generated content before relying on it for academic submissions.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind.

8. Limitation of Liability

To the maximum extent permitted by law:

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

9.1 By You

You may delete your account at any time from your account settings. Upon deletion, your conversations and personal data will be removed within 30 days, except where retention is required by law (e.g., payment records).

9.2 By Us

We may suspend or terminate your account if:

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or a prominent notice on the Platform. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before filing a claim, you agree to contact us at legal@trivium.education to attempt to resolve the dispute informally.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
